  • You can be turned away at the border for a DUI. A DUI in the United States is serious criminality in Canada. This means that you can only apply for criminal rehabilitation five years after the end of your conviction.

  • Canada does not classify offenses in the same way as the United States. The main consideration is whether the offense has a criminal equivalency in Canada and the maximum possible sentence, regardless if you were convicted of it.

  • A Temporary Resident Permit is a temporary waiver usually (but not always) good for one visit. Criminal Rehabilitation is a permanent solution. You may need both depending on your circumstances.

Is Lawgical Law Corporation a private pardons/waiver company?

No! We are a law firm specializing in immigration law. When you hire our firm you receive competent work from legal professionals and are entitled to solicitor-client privilege and confidentiality. You should seriously ask yourself if you are comfortable allowing a waiver/pardons company having access to your confidential and private criminal record history.

I have a criminal record in the United States, can I come to Canada?

If you have a criminal record you may be inadmissible to Canada on the grounds of criminality. This will prevent you from crossing over the border and entering Canada.

I believe that I have been Deemed Rehabilitated, Can I Come to Canada?

Even if you believe that enough time has passed since your last criminal conviction, you must still APPLY for criminal rehabilitation to be allowed entry into the country.

I only have a DUI, is this enough to be stopped at the border?

If you’ve been convicted of driving while impaired, you may be inadmissible to Canada for serious criminality. This means that you generally can’t enter Canada. If that’s the case, there are options for you to enter Canada temporarily, or to become admissible again.

How can I enter Canada if I have a criminal record?

Depending on the type of crime you were convicted of in the United States, and the nature of your conviction, you may either be “deemed” rehabilitated and permitted to enter, or you will require criminal rehabilitation before entering.

“Deemed rehabilitation” is when depending on the type of crime you committed, and the time that has passed since your conviction, you are no longer a concern to border officials.

“Criminal Rehabilitation” is when depending on the type of crime you committed, and the time that has passed since your conviction, usually in a time span shorter than deemed rehabilitation, you make an application to show that you are unlikely to commit new crimes.

I need to urgently enter Canada but I have a criminal record, is there any other option to enter?

Yes. Based on your situation you may want to consider applying for a Temporary Resident Permit (“TRP”). A TRP is a temporary waiver that allows you to enter Canada. The processing time is usually faster than a rehabilitation application, and in many cases, it would be suggested that you make both of these applications to facilitate a temporary and permanent solution to your inadmissibility problem.

How can Lawgical Law Corporation help me enter Canada with a criminal record?

The rehabilitation process requires collecting your criminal record, making an analysis of your specific circumstances and submitting appropriate documentation and submissions to CBSA.

As immigration lawyers, our law firm has experience in making legal submissions to CBSA and other immigration authorities for individuals who are attempting to enter or stay in Canada. When you retain our firm for your legal issues, you can trust that you are getting advice and legal work from legal professionals.
